Ffibr Cyf Fibre Broadband Terms and Conditions (36-Month Contract)

Welcome to Ffibr Cyf! These comprehensive Terms and Conditions govern the provision and use of our fibre broadband services under a 36-month minimum term contract. By signing up or using our service, you agree to these terms, ensuring a clear understanding of our commitment to you and your responsibilities as a valued customer. Your agreement with Ffibr Cyf

Below you will find the detailed terms that outline our service agreement, payment structure, equipment responsibilities, and more. This document is designed to provide full transparency and clarity on our partnership, ensuring you have all the information you need regarding your Ffibr Cyf fibre broadband service.

1. Agreement overview

1.1 These Terms and Conditions (“Terms”) govern the provision of fibre broadband services (“the Service”) by Ffibr Cyf (“the Company”, “we”, “us”, “our”) to the Customer (“you”, “your”) under a 36‑month minimum term contract.
1.2 By signing up for the Service or using it, you agree to be bound by these Terms.
1.3 This Agreement begins on the date of service activation (“Start Date”) and continues for 36 months, unless terminated earlier in accordance with these Terms.

2. Service provision

2.1 The Company agrees to supply fibre broadband service to the address specified in your order, subject to network availability and feasibility.
2.2 Installation will be arranged by appointment. You must ensure access to the premises at the agreed time.
2.3 The Company may use third‑party contractors for installation and maintenance.
2.4 While we will use reasonable skill and care to provide an uninterrupted service, the Company cannot guarantee a fault-free service.

3. Contract term and renewal

3.1 The Service will be provided for a minimum fixed term of 36 months from the Start Date.
3.2 After the minimum term, the contract will continue on a monthly rolling basis unless terminated by either party with at least 30 days’ written notice.
3.3 If you request termination before the end of the 36‑month term, early termination charges will apply (see Section 10).

4. Payments and billing

4.1 Service fees are payable monthly in advance via Direct Debit.
4.2 The first payment may include installation fees, equipment charges, and any applicable one‑time fees.
4.3 You must ensure that your Direct Debit details are accurate and that sufficient funds are available each month.
4.4 Failure to make payment may result in service suspension or contract termination, and may incur a late payment fee.
4.5 All prices include VAT unless otherwise stated.

5. Equipment

5.1 The Company may supply a router or modem for use with the Service.
5.2 Any equipment provided remains the property of the Company unless purchased outright.
5.3 You must take reasonable care of the equipment and return it within 14 days of contract termination (unless purchased).
5.4 Damage or loss may incur replacement charges.

6. Your responsibilities

6.1 You agree to use the Service legally, responsibly, and in accordance with this Agreement.
6.2 You must not use the Service for unlawful, fraudulent, or abusive purposes.
6.3 You are responsible for maintaining the security of any devices connected to the Service.
6.4 You may not resell or share the Service outside of your household or business premises.

7. Network and maintenance

7.1 We may need to temporarily suspend the Service for network maintenance, upgrades, or repairs.
7.2 We will aim to provide prior notice of planned outages where possible.
7.3 The Company is not liable for interruptions caused by factors beyond our reasonable control (e.g., power failures, third‑party provider issues, natural events).

8. Speed and performance

8.1 Advertised broadband speeds are “up to” speeds and may vary based on location, equipment, and network load.
8.2 We will make reasonable efforts to maintain consistent speed and quality but cannot guarantee performance at all times.

9. Changes to service or terms

9.1 We may modify the Service or these Terms where necessary for operational, legal, or pricing reasons.
9.2 Any significant change will be notified at least 30 days in advance.
9.3 If you do not agree to the changes, you may cancel your contract within that notice period without penalty.

10. Cancellation and early termination

10.1 You may cancel the Service at any time during the first 14 days from activation (“Cooling‑off Period”) without penalty.
10.2 After this period, early cancellation before the 36‑month term ends will incur a termination fee equal to the remaining monthly charges due under the contract, less any applicable discounts or savings.
10.3 You must give at least 30 days’ written notice to terminate the Service.
10.4 The Company may terminate the Service for non‑payment, misuse, or breach of contract.

11. Liability

11.1 The Company’s liability is limited to the value of three (3) months’ Service Fees.
11.2 We are not liable for indirect, consequential, or incidental losses including loss of business, profits, or data.
11.3 Nothing in these Terms limits our liability for death or personal injury caused by negligence or fraud.

12. Data protection and privacy

12.1 We will process your personal data in accordance with the UK GDPR and Data Protection Act 2018.
12.2 Your details will be used only for the purpose of providing and managing your Service, and will not be shared except as required by law or to deliver the Service.

13. Governing law

13.1 These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of England and Wales.
13.2 Both parties agree to submit to the exclusive jurisdiction of the courts of England and Wales.
